optimizaci\u00f3n de la tributaci\u00f3n del impuesto<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1764c887 elementor-widget elementor-widget-text-editor\" data-id=\"1764c887\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Establece el art\u00edculo 21 del Real Decreto Legislativo 7\/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley de Suelo y Rehabilitaci\u00f3n Urbana, que todo suelo se encuentra en una de estas dos situaciones b\u00e1sicas:<\/p><ul><li>Suelo rural.<\/li><li>Suelo urbanizado.<\/li><\/ul><p>Sin embargo, a los exclusivos efectos catastrales los inmuebles se clasifican en:<\/p><ul><li>Bienes inmuebles urbanos (BIU)<\/li><li>Bienes inmuebles r\u00fasticos (BIR)<\/li><\/ul><p>Aparte nos encontramos los bienes Inmuebles de caracter\u00edsticas Especiales (BICE) que son un conjunto complejo de uso especializado como pueden ser las presas, las autopistas, los aeropuertos\u2026.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-04c9cf7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"04c9cf7\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-addc56a\" data-id=\"addc56a\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c21e94d separador-4-izq elementor-widget elementor-widget-heading\" data-id=\"c21e94d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">\u00bfC\u00f3mo se calcula el valor catastral de los BIR?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-905155f elementor-widget elementor-widget-text-editor\" data-id=\"905155f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>La valoraci\u00f3n para la Hacienda P\u00fablica de los inmuebles r\u00fasticos se realiza de distinta forma, seg\u00fan a qu\u00e9 est\u00e1 destinado:<\/p><ul><li><strong>Si tiene un uso principal agrario:<\/strong> el suelo est\u00e1 destinado a cultivo propio de su naturaleza y se valorar\u00e1 seg\u00fan sean tierras labradas (de regad\u00edo o secano) o tierras cubiertas con especies forestales o pastos (plantas herb\u00e1ceas o arb\u00f3reas o arbustivas). Est\u00e1n publicados tipos evaluatorios para cada municipio, dependiendo del cultivo, y cada subparcela tendr\u00eda asignado su calificaci\u00f3n catastral y de su intensidad productiva.<\/li><\/ul><p>Cabe recordar que <strong>entra dentro del deber de declarar<\/strong> del titular catastral cualquier modificaci\u00f3n de uso o destino y los cambios de cultivo o aprovechamiento.<\/p><p>Adem\u00e1s, est\u00e1 establecido un<strong> sistema de comunicaci\u00f3n<\/strong> entre administraciones con la Direcci\u00f3n General del Catastro, entre otros con el Ministerio de Agricultura, Pesca y Alimentaci\u00f3n, relativa a los cambios de cultivo y aprovechamiento de los bienes inmuebles r\u00fasticos, de las que tengan conocimiento con motivo de las solicitudes de ayudas de la Pol\u00edtica Agraria Com\u00fan (PAC).<\/p><ul><li><strong>Si existe una construcci\u00f3n sobre el suelo r\u00fastico,<\/strong> hay que determinar si la construcci\u00f3n es indispensable para el desarrollo de la explotaciones agrarias, ganaderas o forestales. <b>Cada una de estas edificaciones se valorar\u00e1 seg\u00fan su destino de forma distinta. <\/b><\/li><\/ul><ul><li style=\"list-style-type: none;\"><ul><li><strong>No indispensable:<\/strong> dependiendo del municipio puede ser considerado urbano a los efectos catastrales.<\/li><li><strong>Indispensable<\/strong> para el desarrollo de la explotaciones agrarias, ganaderas o forestales.<\/li><\/ul><\/li><\/ul><ul><li><strong>Urbanizables sin ordenaci\u00f3n detallada.<\/strong><\/li><\/ul><p>Resumiendo hasta ahora:<\/p><ul><li>Suelo r\u00fastico con cultivo tiene su valoraci\u00f3n con su tipo de gravamen de r\u00fastico.<\/li><li>Suelo r\u00fastico con construcci\u00f3n se complica un poco la situaci\u00f3n al tener que determinar si es indispensable esa construcci\u00f3n para el uso propio rural del suelo y depende adem\u00e1s la naturaleza que se le asigna del a\u00f1o en que el municipio sufri\u00f3 un procedimiento de valoraci\u00f3n colectiva de car\u00e1cter general.<\/li><li style=\"list-style-type: none;\">\u00a0<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-bebb8b1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"bebb8b1\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-34c69a0\" data-id=\"34c69a0\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div ordenaci\u00f3n?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1bc9a22 elementor-widget elementor-widget-text-editor\" data-id=\"1bc9a22\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"background-color: var(--euro-blanco); color: var(--euro-negro);\">Como consecuencia de la STS del 30 de mayo de 2014, se introdujo en la normativa catastral a trav\u00e9s de la innovadora Ley 13\/2015, de 24 de junio, de Reforma de la Ley Hipotecaria aprobada por Decreto de 8 de febrero de 1946 y del texto refundido de la Ley de Catastro Inmobiliario, aprobado por Real Decreto Legislativo 1\/2004, de 5 de marzo, adem\u00e1s de todo el tema de la coordinaci\u00f3n, una nueva redacci\u00f3n que recog\u00eda el criterio jurisprudencial que consideraba que <\/span><span style=\"background-color: var(--euro-blanco); color: var(--euro-negro);\"><b>los suelos urbanizables sin planeamiento de desarrollo detallado o pormenorizado deben ser clasificados como bienes de naturaleza r\u00fastica<\/b><\/span><span style=\"background-color: var(--euro-blanco); color: var(--euro-negro);\"> y se aprobaron nuevos criterios para su valoraci\u00f3n.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-8742f65 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8742f65\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-31ed1a7\" data-id=\"31ed1a7\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap Presupuestos Generales del Estado.<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d644235 elementor-widget elementor-widget-text-editor\" data-id=\"d644235\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"background-color: var(--euro-blanco); color: var(--euro-negro);\">Como peculiaridad que el tipo de gravamen aplicado es distinto al de urbana, entre otras \u201canomal\u00edas\u201d que tiene la formaci\u00f3n de la cuota l\u00edquida de los BIR.<\/p><p>La normativa tributaria establece un tipo de gravamen distinto en atenci\u00f3n a si son bienes inmuebles urbanos, r\u00fasticos o de caracter\u00edsticas generales, con un <b>m\u00e1ximo de 1,10 para los urbanos y de un 0,90 para los r\u00fasticos<\/b>, pudiendo ser ampliado los puntos porcentuales dependiendo de las caracter\u00edsticas intr\u00ednsecas de cada municipio:<\/p><table
